Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the website at qazana.net and the products and services provided by Qazana Systems LTD ("Qazana", "we", "us", or "our"), including Qazana Atlas, Qazana Signal, and Qazana Flow (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

2. Eligibility

You must be at least 18 years of age to use the Services. By creating an account or using the Services, you represent that you meet this requirement.

3. Account Registration

To access certain features, you must create an account. You agree to provide accurate and complete information during registration and to keep your account credentials secure. 4. Services and Plans

Qazana offers both free and paid subscription plans. The features available to you depend on the plan you select. We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

Free-tier accounts may have limitations on features, storage, or usage. Details of each plan are available on our website at the time of signup.

5. Payments and Billing

Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on the plan you select). Payments are processed securely by Paystack Payments Kenya Limited. By subscribing to a paid plan, you authorise Paystack to charge your chosen payment method for the applicable fees.

You are responsible for providing valid and current payment information. If a payment fails, we may suspend access to paid features until the payment is resolved.

Prices are subject to change. We will provide at least 30 days' notice before any price increase takes effect on your existing subscription.

6. Refund Policy

All payments are final and non-refundable. Please review our Refund Policy for full details.

7. Cancellation

You may cancel your paid subscription at any time through your account settings or by contacting us at Click to reveal. Upon cancellation:

  • Your subscription remains active until the end of the current billing period.
  • You will not be charged for subsequent billing periods.
  • Your account will revert to the free plan at the end of the paid period.

8. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law or regulation.
  • Infringe the intellectual property or privacy rights of others.
  • Transmit malware, spam, or other harmful content.
  • Attempt to gain unauthorised access to our systems or other users' accounts.
  • Interfere with the proper functioning of the Services.
  • Use the Services for any fraudulent or illegal purpose.

We reserve the right to suspend or terminate your account if you violate these terms.

9. Intellectual Property

All content, code, design, trademarks, and other intellectual property associated with the Services are owned by Qazana Systems LTD or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Services without our prior written consent.

You retain ownership of any data or content you create using the Services. By using the Services, you grant us a limited licence to store, process, and display your content solely for the purpose of providing the Services to you.

10. Data and Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in accordance with the Kenya Data Protection Act, 2019.

11. Service Availability

We strive to keep the Services available at all times but do not guarantee uninterrupted access. The Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. See our Delivery Policy for details on service access.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Qazana Systems LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising from your use of or inability to use the Services.

Our total liability to you for any claims arising from or related to these Terms or the Services shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Qazana Systems LTD, its officers, directors, and employees from any claims, losses, or damages (including legal fees) arising from your use of the Services or violation of these Terms.

14. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you through the website or via email. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from or relating to these Terms or the Services shall be resolved in the courts of Kenya, unless otherwise agreed upon by both parties.
